U.S. District Judge Grants Illegal Migrants the Right to Bear Arms, While Colorado Lawmakers Deny Law-Abiding Coloradans

In a shocking turn of events, a U.S. District Judge has granted constitutional rights to migrants who entered the United States illegally, while the liberal Democrat-controlled Colorado legislature continues to dismantle the Second Amendment rights of law-abiding Coloradans.
U.S. District Court Judge Sharon Coleman of the Northern District of Illinois dismissed firearm possession charges against Heriberto Carbajal-Flores, an individual who was unlawfully in the United States when he possessed a handgun in Chicago in 2020.
Judge Coleman cited lower court rulings in her decision, stating that Carbajal-Flores' criminal record, which did not include any improper use of a weapon, along with the non-violent circumstances of his arrest, do not indicate a risk to public safety that would justify depriving him of his Second Amendment right to bear arms in self-defense. It is important to note that Judge Coleman was appointed under the Obama administration.
Carbajal-Flores was charged under Title 18 of the U.S. Criminal Code, which prohibits undocumented individuals from possessing firearms or ammunition. However, the defendant argued that he possessed the firearm for self-defense and protection of property during a time of civil unrest following the killing of George Floyd.
Interestingly, the court previously denied two motions by Carbajal-Flores to dismiss the charges, according to the reporting of Fox News. The timing of the second denial, six months after the U.S. Supreme Court struck down a New York law that required individuals to show "proper cause" to obtain a license to carry a firearm outside their homes, raises questions about the consistency of legal decisions regarding Second Amendment rights.
In May 2023, the U.S. Supreme Court ruled in favor of gun control advocates in Illinois, denying a request for an emergency injunction against the state's ban on the sale and new possession of semiautomatic firearms. This ruling came in response to Illinois Governor J.B. Pritzker's enactment of a statewide ban on "assault-style" weapons and restrictions on magazine capacities.
Critics argue that the granting of Second Amendment rights to illegal migrants sets a dangerous precedent. Political commentator Jay Oliver, via Daily Mail, points out the civil duty of gun shop owners to lawfully indemnify those who attempt to obtain firearms through legal means. The progressive nature of those in charge of courts and opinions, Oliver suggests, may lead to more cases where innocent lives are at risk due to lax enforcement of gun laws.
