Rep. Tom McClintock (R-Calif.) and Rep. Ken Buck (R-Colo.) have taken a stance against the impeachment of Secretary of Homeland Security Alejandro Mayorkas, despite overwhelming evidence of his failure to secure the U.S. southern border.

This opposition from two Republican representatives further weakens efforts to hold Secretary Mayorkas accountable for his actions. With several other Republicans still undecided, the chances of successfully impeaching Mayorkas with the current razor-thin House majority are diminishing.

If the impeachment does proceed, the Democrat-controlled Senate is highly unlikely to convict Mayorkas.

In a 10-page memo, Rep. McClintock argued that the articles of impeachment drafted by the Homeland Security Committee fail to identify any impeachable crime committed by Mayorkas. He accused the committee of stretching and distorting the Constitution to hold the administration accountable for stretching and distorting the law.

McClintock also expressed his belief that the Senate will not vote to remove Mayorkas based on the grounds laid out in the articles, suggesting that it will be a bipartisan repudiation of a supposed misuse of power.

The articles of impeachment accuse Mayorkas of "willful and systematic refusal to comply with the law" and "breach of public trust," focusing on his alleged failure to enforce laws regarding the detention and deportation of migrants along the U.S.-Mexico border. These allegations highlight the very real concerns about border security and the need for a strong and effective leader at the helm of the Department of Homeland Security.

For many, it is deeply troubling that Rep. McClintock and Rep. Buck are choosing to downplay the seriousness of the situation at the border and ignore the evident failures of Secretary Mayorkas.

The role of the Department of Homeland Security is to protect the American people and uphold the rule of law. When there are clear indications of a lack of enforcement and a breach of public trust, it is the duty of elected officials to hold those responsible accountable.
