Cops Called on Black Comedian at DIA – He Claims Racism
Marlon Wayans, well-known actor, and comedian is claiming that he is being unfairly prosecuted after a recent “incident” at Denver International Airport (DIA). According to Wayans' attorneys, racial discrimination played a major role in the incident that led to him being cited for disturbing the peace.
On Thursday, Wayans' legal team filed a court document asking for the dismissal of the case against him. They allege that the dispute, which started over a luggage issue, was fueled by the gate agent's prejudice towards Wayans' race.
A spokesperson for United tells us, "In Denver on Friday, a customer who had been told he would have to gate-check his bag instead pushed past a United employee at the jetbridge and attempted to board the aircraft. The customer won't be flying on United to his destination." (TMZ)
The incident took place in June, when Wayans was attempting to board a United Airlines flight to Kansas City.
According to the court filing, a gate agent informed Wayans he could not board with three bags, but then tried to physically stop him from boarding even after he consolidated his luggage into two bags. Despite this, Wayans was eventually allowed to board the flight. However, he was then asked to deplane by the same gate agent.
The court document includes still photos from surveillance footage, which show multiple white passengers being allowed to board with three bags, in violation of United's policy. Wayans' lawyers argue that this is clear evidence of racial discrimination by the gate agent
According to the filing, around 140 people boarded the flight, many of whom had three bags or oversized bags. Despite this, it was only Wayans who was singled out and cited for disturbing the peace. Wayans' lawyers state that this is a clear violation of his constitutional rights to equal protection under the law.
However, City Attorney Kerry Tipper refused to comment on the ongoing case. United Airlines also did not respond to requests for comment.
Marlon, who was set to perform Friday night at Kansas City Improv, says the whole ordeal has forced him to miss his show, writing, "It's not my fault blame the gate agent and United Airlines can't believe how they allow their first class customers to be treated this way. I need corporate to reach out DM me. this agent was rude." Side note ... if you haven't seen "White Chicks" do it ... it's a classic.
In response to questions about the incident in June, United released a statement saying that a customer had "pushed past" an employee at the jet bridge and attempted to board the plane. This contradicts statements recorded on police body camera, in which the gate agent states that Wayans had "shoved," "pushed," or "elbowed" him while boarding.
Wayans' lawyers argue that this is a lie and that he may have simply brushed shoulders with the agent while boarding. The police officers who investigated the incident expressed doubts that any crime had occurred, but the gate agent insisted that charges be pursued against Wayans.
Wayans' lawyers argue that the prosecution against him is a result of racial discrimination and is a violation of his rights. The case is ongoing.
